  1. General

1.1. These Terms of Use are a binding and legal agreement between you and theloop.com and/or the operator of theloop.com (collectively, “theloop”) and governs your use and/or activities in connection with theloop and its services, including without limitation, transmissions, applications, posts, uploads, and chats (collectively, the “Services”). By using or accessing theloop you hereby agree to these Terms of Use and agree to be bound by them.

1.2. theloop reserves the right, in its sole discretion and without prior notice, to revise, change and/or modify these Terms of Use at any time and will display its most current version at theloop.com.

You hereby agree to periodically review these Terms of Use and to be updated of any modification or change. By continuing to access and/or use theloop you hereby agree to the Terms of Use which are in effect at such time.

1.3. These Terms of Use and the documents, instruments and other agreements specifically referred to herein, including the Privacy Policy, constitute the full and entire agreement and understandings between you and theloop with respect to the Services, and supersedes and cancels any and all prior agreements, understandings, and representations made by of theloop.

  1. Your Content and Information

2.1. You are solely and exclusively responsible for all content and information transmitted, posted, or displayed by you on theloop. You hereby agree and warrant that you will adhere and comply with these Terms of Use and any other agreements referred to herein, including any other relevant rules and regulations, and agree to use the Services in accordance with all other applicable law, including the laws of the country in which you are resident or from which you use the Services.

2.2. You hereby agree and acknowledge that theloop may not control the information and content transmitted, posted or displayed via its Services and will not be responsible or liable for any information or content posted by other users. In no event is theloop, its directors, officers, employees, representatives and/or affiliates, will be liable and responsible for your content and information.

2.3. You hereby warrant and represent that you own or possess the legal rights to all content and information transmitted, posted or displayed by you in theloop, including without limitation, copyrights, trademarks, service marks and any and all other information and proprietary rights in connection with the content and information. You agree that you have the power and authority to display, post and transmit the content and information on theloop and acknowledge that in any event of infringement, claim or dispute regarding the ownership and/or rights to use the content and information, you (and not theloop) will be solely and exclusively liable for such action, including the use of your content and information by any third party.

  1. Restrictions and Obligations

3.1. You hereby agree and undertake not to do any of the following while accessing or using theloop and any of its Services:

3.2. You will not transmit post, send or communicate in any other way any unauthorized or illegal communication (such as spam, mail bombing etc.).

3.3. You will not upload or send any viruses or any other unsafe code via the Services.

3.4. You will not transmit, post, or display any content or information which is, or may seem, unlawful, threatening, hateful, abusive, harmful, obscene, harassing, violent or any other kind of other objectionable content, acted, displayed or depicted on theloop.

3.5. You will not use copyrighted content without written approval from the copyright owner.

3.6. You will not use theloop and any of its Services to advertise or promote any commercial entities and/or activities via means which are not dedicated for such purpose.

3.7. You will not use theloop and any of its Services to do any unlawful, misleading, discriminating or malicious activities.

3.8. Obligations. You will use theloop services in accordance with the Apple store and/or Google Play policies and regulations. You hereby agree to periodically review both Apple store and/or Google Play policies and to be updated of any modifications or changes.

 

Privacy:

  1. General

1.1. This Privacy Policy sets forth theloop procedures and policies with respect to the collection, use and disclosure of its users’ information. By accessing theloop and/or using its services, you hereby consent to the collection, use, transfer, storage, manipulation, disclosure and other uses of your information as further set forth in this Privacy Policy.

1.2. This Privacy Policy covers theloop. It does not apply to other entities that theloop does not own or control, such as applications or websites using theloop and/or any of its services, including without limitation, transmissions, posts, uploads, and chats (collectively, the “Services”).

1.3. theloop reserves the right, in its sole discretion and without prior notice, to revise, change and/or modify this Privacy Policy at any time and will display its most current version at theloop.com. You hereby agree to periodically review the Privacy Policy and to be updated of any modification or change. By continuing to access and/or use theloop you hereby agree to the Privacy Policy which is in effect at such time.

1.4. theloop forbids users under the age of 13 to create an account and use theloop and/or any of its Services.

In the event that theloop becomes aware that a user under the age of 13 has shared any information, it will terminate the account in question. If you have any reason to believe that a child under the age of 13 has shared any information with theloop, please contact us at privacy@theloop.com.

1.5. For minors older than 13, theloop strongly advise that they ask their parents for permission before posting information about themselves on theloop. theloop also recommend that parents take time to explain to their children about what is safe or not on the internet and inside a social network.

  1. Information provided to or shared in theloop

2.1. While using theloop and/or any of its Services, you may provide us and/or the developers of applications with certain information. Moreover, when using theloop and/or its Services, you may share some of your content with theloop, its developers and/or its users. You hereby agree and acknowledge that theloop may use such information in order to administer its Services to you and tailor the Services to its users and/or developer’s needs.

2.2. While accessing and/or using theloop and/or any of its Services, theloop automatically records some of the information which your browser sends (“Browser Information”). Such Browser Information may include, without limitation, your browser type, sites which you have previously visited, pages of theloop which you have visited, IPs, information you have searched on theloop, other activity you did in theloop and other details. You hereby agree and acknowledge that theloop may use such Browser Information in order to assist, supervise, monitor and analyze your use and/or to provide Services to other users.

2.3. In order to avoid any identity theft (also known as phishing) theloop does not and will not ask you for your credit card information, login password, account ID, or national identification numbers in a non-secure or unsolicited email or telephone conversation.

The site may track a user’s activity by issuing Cookies when entering the site.

To streamline navigation on our site we use both Session ID cookies and Persistent cookies.

How may we use the information held by us?

theloop may use this information to improve our marketing and products/services including customizing our site to your needs and interests.

theloop may also use information about you to deliver information to you that, in some cases, is targeted to your interests whether on the site or via email.

theloop may use this information to answer your questions, troubleshoot problems and enforce our Terms and Conditions.

theloop will use your email address to contact you.

When may we disclose your information?

theloop may disclose your information to our affiliated companies and sites and to our service providers who are authorized to use the information only for purposes of providing services to you and us and our affiliated companies. Information may be presented to third parties in statistical form but this shall not be personally identifiable. theloop’s business and the internet world in general are very dynamic and we may arrive at a situation in which theloop sell a part of our business or all of our business. In such a case theloop may transfer information collected by us to such third party. Obviously, in case theloop are required by law enforcement agencies and/or in case we find it necessary in order to enforce intellectual property or other rights, theloop may disclose your information.

Third party collection of information

theloop’s policy only addresses the use and disclosure of information we collect from you. To the extent that you disclose your information to other parties on theloop’s system or other sites throughout the internet, different rules may apply to their use or disclosure of the information you disclose to them.

How can you update or delete the information held by us?

You have the following choices to update your information from theloop’s database: You can send our Customer Service Department an email at info@theloop.com or you may log in with your password and update or delete your profile.

Please note that the information is not deleted from the company’s database but will be saved under a deleted status and will not be presented on the site.

  1. Sharing Information and Disclosure

4.1. theloop’s users can interact with and use Social Networking Services (SNS). Should you use an SNS via the Services, you hereby agree and understand that theloop may access and store your account information.

4.2. You agree and understand that theloop may disclose and share your non-identifying information, including Browser Information, with third parties in order to deliver Services to you and for industry analysis and demographic profiling. In addition, theloop may also provide your information to its service providers for the sole purpose of allowing them to facilitate theloop’s Services or to assist theloop in analyzing its Services.

4.3. theloop may freely assign, share, disclose or transfer any of your information, including your Browser Information, in connection with an acquisition, merger, sale of its assets, or by operation of law, or otherwise.

  1. Deleting or Removing Information

5.1. You may delete and/or change your account information at any time by editing your account information. But even after you remove information from your profile and/or delete your account, parts of that information may remain viewable to the extent it has been shared with others.

5.2. theloop will use commercially reasonable efforts to honor your request; however, you understand that theloop may retain archived copies of your information.

  1. Law Enforcement

6.1. theloop reserves the right to disclose any content and/or information it reasonably believes is necessary (i) to satisfy and enforce any applicable law, legal process or governmental request, (ii) detect or prevent any security and technical matters, including protecting the rights, property and security of theloop and any of its users, and (iii) respond and attend to any support users’ request.

6.2. theloop’s option menu allows you to set privacy options that limit access to your information. But unfortunately there are no security measures there are totally safe on the internet. You must also remember that you are sharing information with others. We cannot be held responsible of the actions of other users or third parties. We encourage you to follow the basic internet security practice by choosing a strong password, by using different passwords with your different accounts on the internet and by having a good and up to date antivirus software.

  1. Governing Law and Jurisdiction

These Terms of Use and any action related thereto will be governed in all respects by, and interpreted in accordance with the laws of the Cyprus in respect of laws to be executed and performed therein, without giving effect to its rules regarding conflicts of laws.
